Key points in Michigan's Earned Sick Time Act!


Accrual of Sick Time:


  • Employees earn 1 hour of sick time for every 30 hours worked.

  • Companies with fewer than 10 employees: Workers can use up to 40 hours of paid sick time per year.

  • Companies with 10 or more employees: Workers can use up to 72 hours of paid sick time per year.

  • Sick time carries over each year, but there are limits on how much can be used annually.



Uses of Sick Time:


Sick time can be used for:

  • The employee’s or a family member’s illness, injury, or medical appointments.

  • Domestic violence or sexual assault recovery, including medical care, counseling, legal services, or moving.

  • Attending meetings about a child’s health at school or their disability.

  • Public health emergencies, such as school closures or exposure to contagious diseases.



Employer Responsibilities:


  • Employers cannot require employees to find a replacement worker when taking sick time.

  • Paid leave like vacation days or personal time off can count as earned sick time if it meets the law’s requirements.

  • Employers must not retaliate against employees for using their earned sick time.



Filing a Complaint:

Employees can file a complaint or take legal action if their rights under the act are violated. They have up to 3 years after the violation to file.
